Breast Cancer

Breast cancer treatment has made great strides in recent years. And physicians continue to make remarkable discoveries to overcome what is the most prevalent cancer in women in the United States. The American Cancer Society estimates that 185,000 new cases of invasive breast cancer are diagnosed. However, early testing and detection is a vital key in preventative medicine. In the majority of cases, when the cancer is treated in its initial stages, chances of a relapse are vastly diminished. Unfortunately, there are occasions when medical practitioners negligently fail to diagnose the symptoms in the early stages. The failure to diagnose any type of cancer that results in a change in the cure or reoccurrence rate may be classified as negligence.

The following are among the more common forms of negligence:

· Failure to recommend a biopsy or removal of a tumor because it has been negligently classified as benign;
· Failure to schedule a patient follow-up;
· Disregarding a patient's history of atypical sharp breast pain;
· Failure to determine the cause of discharge;
· Failure to identify a palpable lump during a breast examination;
· Failure to perform a breast examination during a routine examination that would have identified an obvious tumor;
· Failure to recommend a biopsy or removal of a tumor because it has been negligently classified as benign;
· Failing to order a biopsy, mammogram, ultrasound, when necessary;
· Failure to properly interpret a mammogram;
· Failure to properly react to positive test findings;
